Republican thought was of fundamental importance to Polish constitutionalism. In the fifteenth century, the term "Rzeczpospolita" was used for the first time — a term that not only became part of the name of the state, but also identified it as the common good. This concept refers to the idea of a community of citizens united under a single law and forming a single state. The Rzeczpospolita is the highest political value and the common good. The Constitution of 1921 uses the term "Rzeczpospolita" to describe the form of the state. Meanwhile, the Constitution of May 3rd, the April Constitution, and the Constitution of 1997 all continue the traditions inaugurated in the fifteenth century. The term "Rzeczpospolita" signifies that the Polish state is the common good of all its citizens.

Profesor doktor habilitowana nauk prawnych, specjalistka w dziedzinie prawa konstytucyjnego, pracuje na Wydziale Prawa, Administracji i Ekonomii Akademii Tarnowskiej w Tarnowie. Pełniła funkcje prodziekana Wydziału Prawa i Administracji Uniwersytetu Śląskiego, prorektora tego Uniwersytetu, a także kierownika Katedry Prawa Konstytucyjnego WPiA UŚ. Była wiceprezesem Polskiego Towarzystwa Prawa Konstytucyjnego. 30 marca 2016 r. została powołana przez Marszałka Sejmu na członka Zespołu Ekspertów do spraw Problematyki Trybunału Konstytucyjnego, który miał za zadanie zająć się kwestiami powodującymi zaistniały w 2015 r. kryzys wokół TK. Autorka wielu publikacji z zakresu prawa konstytucyjnego porównawczego (Portugalia i Hiszpania) oraz polskiego prawa konstytucyjnego (m.in. redaktor naukowy i współautorka 3-tomowej monografii poświęconej idei solidaryzmu: Idea solidaryzmu we współczesnej filozofii prawa i polityki, Idea solidaryzmu we współczesnym prawie konstytucyjnym, Państwo solidarne), a także wielu ekspertyz i opinii naukowych. Członek Rady Legislacyjnej przy Prezesie Rady Ministrów od 2016 r. W 2024 r. otrzymała Nagrodę Peregryna z Opola przyznawaną za umiłowanie sprawiedliwości.
